Pixelweb Design Terms of Service

Read the following terms and conditions carefully. By using our products or services, you agree to be bound by these terms and conditions.

We reserve the right to change this policy anytime, so please check this page at least monthly or when in doubt.


IE Domain Refund Policy.

Due to the amount of administration time it takes to process.ie domain names, no refunds are available if you fail to provide the required documentation to support the claim to the domain name in the required time frame of 28 days.

Acceptable Use Policy

We strive to provide the best possible services to all our customers, however we will not tolerate any illegal activities or abuse on our servers! We respect freedom of expression unless it harms others. These brief guidelines are put in place to protect you, other customers, and us from any harm.

You can cancel at any time. We don't accept cancellations for phone requests. If you want to cancel your account, please call customer service at [email protected]
You must cancel your account at least five business days before your account renews. It is the Client’s responsibility to ensure that they have received an email confirming their cancellation. If the client hasn't received an email confirming their account cancellation, then they remain active, and you'll continue to be invoic­ed.

If Client has a payment due at the time of cancelling, this payment must be made in full. Cancelling a project does not absolve the client from any outstanding financial obligations.

You agree to use the services and facilities at your own risk. We specifically disclaim any warranties of merchantability or fitness of a particular purpose on our web site. We're not responsible if anything happens to your data or computer system. Customer agrees that it shall defend, indemnify, save and hold Pixelweb Design harmless from any and all liabilities, costs, damages, and expenses (including reasonable attorney’s fee) arising out of any services provided or performed by Pixelweb Design or its agents, employees, or assigns.

Customer agrees to defend, indemnify and hold harmless Pixelweb Design against liabilities arising out of:

(1) Any injury to person or property resulting from any product sold or otherwise distributed by Pixelweb Design's server.

(2) any materials provided by customers that infringe or allegedly infringe on the proprietary rights of third parties.

(3) Copyright infringement and (4) defective products sold by Pixelweb Design's server to its customers.

We shall be the sole judge whether something violates our policy.

We're committed to an anti-spamming, zero-tolerance policy. Under this policy, spamming includes sending unsolicited commercial emails either: Over the PixelWeb Design network; OR over ANY network if the email sent advertises or mentions any site hosted on the PixelWeb Design server.

We take violations of our terms of service seriously and reserve the right to terminate your account without prior notice if you violate them. Sending unsolicited commercial emails (a.k.s. spam) is prohibited. Cross-posting messages to multiple newsgroups or forums is prohibited. Posting obscene or threatening messages while making use of or referencing a Pixelweb Design email address is prohibited. Using Pixelweb Design servers as an email address for responses to activities described here is also prohibited. Accounts that were canceled for spam reasons will be billed a ‘clean up’ fee of €600.

All services provided by Pixels Web Design may be used for legal purposes only. Any transmission, storage, or presentation in violation of any law, regulation, or rule is prohibited. This includes, but isn't limited to: copyrighted material (including images), trademarks, intellectual property, material that we judge to be threatening, obscene, or otherwise inappropriate for any reason, and material that is subject to copyright protection under U.S. law. By using the service, the subscriber agrees to indemnify Pixelweb Design and hold them harmless from any claims resulting from damage caused by the subscriber or any other person.

Pornographic and sex-related merchandise is prohibited on all PixelWeb Design servers. This includes sites that might be inferred to contain sexual content, or links that take you to adult content elsewhere. Pixelweb Design will decide whether any violation has occurred.

We don't allow any websites that promote any illegal activities or present content that could damage our servers or any other server online. Links to such materials may be prohibited.

Examples of unacceptable content or links:


Hacker programs or archives do not host websites of their competitors or promote websites of their competitors.

If you engage in any illegal activities, including adult content, linking to adult content websites, spamming, or hacking, we may close your account and delete all your files without notice.

Pixelweb Design will determine whether something violates our terms of service.

We cannot be held responsible for any unsolicited email, spam, email bomb, hate mail, or any mass email sent by anyone using our services. Your email address may not appear as the originator, intermediary, nor reply-to address of any emails sent by us. We consider mass emails any email message sent to 25 or more email addresses or 10 or more newsgroups.

Each account has its own CGI-BIN. You're free to use any CGI programs you want, but we reserve the right to turn off any CGI program that affects our servers' performance or services to other Pixelweb Design clients. You will be notified within 24 hours if there is an issue with the cgi script. We don't allow any chat rooms or similar scripts.

We don't allow chat rooms. However, you can't directly link your site to a messaging service. There are many different types of chat services available, including: www.humanclick, www.liveperson, and www.

Pixelweb Design allows you to get a lot of traffic, and most sites don't go above 500 MB per month unless they're offering shareware, sound, videos, images and multimedia archives, are mirrors or any site whose primary function is file distribution. Customers are discouraged from storing any file types that cause excessive traffic on our servers. For more information, please contact our technical support team. Most websites don't fall into this category and rarely reach our traffic limits.

We reserve the right not to serve anyone for any reason whatsoever. We reserve the right to terminate our services to any customer at any time for any reason not prohibited under law.

If you deliberately attempt to cause damage to our servers, we will immediately deactivate your account without prior notice. Refunds are not given in this case.

All account plans include a predetermined number of visitors. We monitor all accounts, and we charge €10.00 per gig of traffic exceeded. You won't be charged for any data transfers you use beyond our generous usage limits without prior notice. You can monitor your traffic at anytime in your Control Panel.

We guarantee that our servers and connectivity will be available for at least 99.99 percent of each calendar month, excluding scheduled maintenances and upstream provider issues. If the monthly outage exceeds the allowed limit of 0.01%, Pixelweb design will charge five percent (five percent) of your monthly fee for each additional 30 minutes of outage, up to one hundred percent (100%) of your monthly fee, excluding any overage fees. If you have one server for each plan, then the average uptime of all servers determines the uptime percentage. To qualify for a credit, you must request it by the end of the month, within 30 days from when you received your statement, and your account must have been in positive standing during that time period.

Full backups are made once a week, and backups of new or changed data are made nightly. There are no guarantees of any kind, either express or implied, as to their integrity. They're not designed to be used as a backup system. It is the client’s responsibility to maintain local copies (or backups) of their web content. Each hosting plan includes an “Backup Manager,” which allows clients to back up their files using the service. If loss of data results from an error of Pixelweb Designs, we will attempt to restore the data for free. If data loss occurs because of negligence of the client in securing their account, or if it occurs because of an action of the client (such as deleting files), Pixelweb Design will attempt recovery of the lost data for a fee of €80.00.

We offer our services at no cost to you for the first year of registration. After the first year, we charge $20 per year for domain name registrations and renewals.

Fees are non-refundible, in whole or in any part, even if your registration was suspended, cancelled, or transfered before the end of your then present registration term. You agree that we may change the domain name registration and renewal fee at any time for any rea­son at our sole discretion. If you don't pay any initial fees or annual renewal fees when they're due or if your credit card charge isn't accepted within three (3) days after an initial fee is due or ten days after an annual renewal fee is due, we'll be able to take control of all.com,.net,.org,.info,.biz,.us,.uk,.ca,.co.uk,.de domains for which payments weren't received. With regard to renewals, we will send an email notification to the billing contact listed in the WHOIS database for the domain name eligible for renewal. It is your responsibility to ensure that any renewal fees are paid before the end of the term of registration for the domain name. We're not liable for anything that happens after you cancel your subscription. We may change our registration and renewal fees at any time 15 days before they go into effect.

We cannot guarantee that you will be able to obtain the exact domain name that you want. However, if you indicate that it is available, we will try our best to get it for you. We cannot guarantee that the domain names you register are free from inaccuracies or mistakes. We reserve the right to decline to register or renew an account at our sole discretion. Such rejections may be caused by requests for registrations or renewals of prohibited domains. We're not liable or responsible for any omissions, errors or any other actions by registry administrators arising out of or relating to your application for and registration of, or failure to register or renew a particular domain name. You also agree to pay the applicable registry administrator and/or registrar for the period during which you own the domain name(s), including the cost of renewals, if applicable, and agree to defend, indemnify, and hold harmless the applicable Registry Administrator and/or Registrar from and against any and every claim, liability, expense, and cost (including reasonable legal fees) arising out of, related to, or resulting from your ownership of the domain name(s).

The term of this agreement will continue to be in effect until the time in which you register a domain name through us. We may register each TLD name at our discretion for periods of one (1) year to ten (10)years for.com,.net, and.org.

After Expiration of The Term of Domain Name Registration.

We reserve the right to renew your domain name for an additional year if we choose to do so. You agree that we may direct the expired domain name to name servers and IP addresses designated by us, including but not limited to, to no IP address, or to an IP address that hosts a parking page or a search engine that displays ads, and you agree that we may either leave the WHOIS information intact or change the contact information in WHOIS output for the domain name so that you no longer own the domain name.

After the term of domain name registra­tion services has expired, you acknowledge that certain registries may provide procedures or grace period during which expired domain names may be renewed. You acknowledge that you take all risks and assume all consequences if you wait to attempt to renew the domain name registration until close to or after its expiration date. We reserve the right to cancel any post-expiration renewal at any time and for any reason. Therefore, we will not be liable for any cancellation. You agree that after expiration or redemption, there may be additional fees which we and our Primary Service Provider may determine, including but not limited to, an annual fee for continued use of the Services. You acknowledge and agree to transfer ownership of any expired domain names to us at any time.

After the end of the term of a.com domain name registration, we may either i) remove the.com domain name from the zone, meaning that the.com domain name will no longer be resolved, or ii) direct the.com domain name to name servers and IP addresses of websites designated by us, including but not limited to IP addresses which host a parking page, a commercial search engine, or a website that offers free email services. Both are functionally equivalent to ICAN's or a registry's grace period, which usually occurs after deletion. If we exercise our right to take action against you for failing to transfer the domain name to another registrar within 30 days, and if you don't contact us to pay for the renewal of the domain name before the end of the 30 day period, then you agree that you have given up the domain name.

You agree that after this 30 day period, we may, possibly through a subcontractor, solicit and provide to a third party to renew the domain name’s registration term and to allow the third party to assume complete ownership of the domain name services as the registrant.

If you don't contact us to renew the service within 30 days, and if we're unable or unwilling to let a third party take over the service, then we can either delete the domain name or we can pay the registry for the domain name so that it continues to be registered. We won't remove it from the Tld zone. If you don't exercise your rights under this clause, you agree that you've abandoned the domain name services and give up all rights and use of them, and that we may register ourselves or someone else as the owner of the domain name. If we exercise our right to terminate this Agreement, you may either 1) let us continue to list the domain name as the registrant, in which case we will continue to point the domain to an IP address designated by us, or 2) you may ask us to remove your information from the domain name's WHOIS record, in which case you will relinquish all rights and controls over the domain name and we may continue to point the domain at an IP address designated by ourselves.

We may share information with you that is pertinent to your use of our Service(s), including but not limited to, any updates or changes to our Terms of Use, Privacy Policy, or Content. These announcements will be predominantly informational in nature and may include noti­cies describing changes, upgrades, news, new products or other informa­tion to add security or to improve your identity on the Internet. They may also include information or announcements which the registry, registrar, or others may require ICANN to distribute.

By clicking "I Agree", you agree to be bound to our Uniform Domain Name Disputes Policy. This dispute resolution policy is incorporated into this agreement by reference. If there are any disputes regarding the right to register your TLD name, they will be resolved by the Uniform Domain Name Disputes Policy. We reserve the right to modify the Dispute Policy in our sole discretion at any point in time in accordance with the terms of the ICANN Agreement or Registry Policies. If you continue using our services after we've modified the terms of service, then you're agreeing to them. You may cancel or transfer your domain name if you don't agree to the proposed changes. You agree that you'll be subject to the provisions outlined in our dispute policy in effect at the time of any challenge from a third party.

When you register or purchase a domain name, you must provide us with certain information, including your contact details. This information includes:

Your full name, mailing address, email address, phone number, and fax number, if available;

For legal reasons, the name of an authorized person (for contact purposes) in the case of a registered individual who is an organization, association or corporation.

The IP address of the primary nameserver for the domain name and any secondary nameservers for the domain name.

The corresponding names of those nameservers;

The full name, mailing address, email address, phone number, and fax number of the technical contact for that domain name;

The full name, mailing address, email address, phone number, and fax number of the administrative contact for.com domain names;

The name, postal addresses, email addresses, phone numbers, and fax numbers (if available) of the billing contacts for the domain names; and any remarks concerning the registered domain names that should appear in the Whois database.

You agree to update the information on this site to keep it current, comprehensive and accurate. You also agree and acknowledge that the foregoing registration data (including but not limited to name, address, telephone number, email address, IP address, and any other information we collect) will be publicly available and available on the WHOIS directory.

Web Design Legal Stuff.

We don't guarantee that the functions contained in our web pages will meet your needs or that the operation of our web pages will be uninterrupted. The entire risk as regards the quality and performance of your web pages and website is on your clients. We're not responsible for any damage caused by our services. If any part of this agreement is found to be unlawful, void, unenforceable, or otherwise invalid, then that part shall be severed from the rest of the agreement and shall not affect its validity and enforceability.

The client represents to us that any elements of text (including but not limited to logos), graphics, photos, designs (including but not limited too illustrations, icons, etc.), trademarks, or other artwork supplied to us for inclusion in web pages belong to the client, or that we have permission from the rightful owner of each element to use each element. We will hold harmless, protect and defend us and our subcontractors from any claim arising from the use of these elements supplied by the client.

Governments sometimes enact laws and levy taxes that affect online electronic commerce. The client agrees that he/she is solely responsible for complying to such laws, taxes, tariffs, and fees, and will hold harmless and defend Pixelweb Design web services and its subcontractors from claims, suits, penalties, taxes, or tariffs arising from the client's use of internet electronic commerce.

Copyright to Web pages.

You own the copyright to the finished assembled work produced by Pixelweb Design. After final payment of this contract has been made, the client is assigned the right to use the design, graphics, text, and any other content contained in the finished assembled web site. You retain ownership of any photos, graphics, source codes, work-ups, and computer programs you create for your clients. We reserve the right to use images and other Web design elements in our portfolio as examples of our work.

Payment of fees.

To keep Pixelweb Design Web Services in business, payments must always be made promptly. If you fail to pay your bill by the due date, we will charge you a €15 late fee. If an amount remains unpaid 30 days after its due day, an additional 5% fee will be added for each additional month of nonpayment. We reserve the right to remove any web page from viewing on the internet until we receive full payment for the project. If collection proves necessary, the customer agrees to pay all fees associated with that process. This contract becomes effective only when signed on behalf of Pixelweb Design Web Service.

Regardless of the location of this contract, the client agrees that this contract was entered into here in Ireland, and any disputes will be litigated or arbitration in Ireland.

If the client stops working within 10 days of starting work, any work done before that date will be billed at the normal rate and deducted from the original deposit. The remaining balance will be returned to the client after deducting any costs incurred.

If, at the point of the request for refund of the initial payment, work has been completed past the amount covered by the original payment, the client shall pay for all work completed past the original payment. You won't get any of your initial payment back unless you write an application for it within 10 days of signing the contract.
